Cancer: Oncology and Accurate Cause

Cancer Cancer is one of the top causes of death in the world today. Studies show that one in three people will go through some form of cancer in their lifetime. There are various different kinds of cancer that effect different parts of the body. Cancer is treated in many different ways. Some forms of cancer are treatable, and some are not. Cancer usually comes from the development of a tumor. Tumors form in the body when cells are produced without cause. New cells are formed when they are not needed, and they group together to form a tumor.The tumor can be benign, which means that it is non-cancerous, or it can be malignant, which means that it is cancerous. If cells break away from a malignant tumor, they will enter the bloodstream, and spread throughout the body, hurting other parts of the body. Cancer can also appear with no definite cause. However, there are some activities that people participate in, that increase the risk of cancer. Smoking can cause cancer of the lung, mouth, and throat. Alcohol can cause cancer of the mouth, throat, and liver. Also, exposure to radiation and sunlight can cause skin cancer.The accurate cause of cancer still remains a mystery. Cancer can be spotted early on by certain symptoms. As cancer progresses through it’s many stages, it will produce certain symptoms. The symptoms depend on the size and location of the cancer. In some areas, symptoms will not appear until the cancer is very large, making the cancer more difficult to treat. The general symptoms of cancer are fever, an alter of metabolism, fatigue, severe weight loss, weakness and dizziness, blood clots, and sores that don’t heal. There are many different ways of treatment for cancer.Surgery is usually the first choice of most patients. If the cancer is localized, meaning it hasn’t spread, surgery is the best option. The surgeon will remove the tumor and the surrounding tissue. Surgery offers the best chance of a cure. The next method of treatment , which is usually a patient’s second choice, is chemotherapy. This method treats cancer cells that have spread. Chemotherapy is used depending on the type of cancer, and the stage it is in. Chemotherapy specifically treats cancer by injecting strong medicine to a patient, and allowing the drugs to travel throughout the body.The side effects include vomiting, hair loss, infections, and fatigue. The last treatment, which is usually a last resort, is Radiation. It destroys cancer cells, so they don’t multiply. More than one half of people with cancer experience Radiation. Radiation is the process of external high-energy rays or implants inserted near the tumor, eliminating the cancer cells. With all kinds of cancer, there are seven main warning signs. These seven signs found in one person would show that the person may be suffering from some type of cancer, and this person should see a doctor immediately.Dying of Breast Cancer in the 1800sThe seven warning signs are a ma jor change in bowel or bladder habits, a sore that does not heal, unusual bleeding, thickening or lump in breast, indigestion or difficulty swallowing, obvious changes in wart or mole, and an irritating cough or roughness. The Effects of Gmo

Daniel Ramirez Lagunas English 12 CP 18 May 2012 FDA Labeling In our society today, there is a small percent of our food that has been genetically engineered. Genetically modified food can affect people that ingest the substances by causing health issues. With these possible long-term effects of GM foods, the FDA, Food and Drug Administration, should require labels for consumers to see. These labels would help inform the public of the possible dangers of the GM food. Without these labels people can suffer serious medical conditions that can destroy their lifestyles.The FDA should require warning labels on all GM foods. GM foods come with many different health risks. One health risk is severe allergic reactions. These allergic reactions can even be life-threatening. An article from the San Francisco Chronicle states that GM fish can possibly cause severe allergic reactions that could be life threatening. â€Å"Genetically engineered fish pose an increased risk of severe, even life-th reatening, allergic reactions to sensitive individuals. † (SF Chronicle).Because of this possible outcome, the FDA should require all GM food to have proper labeling warning consumers of the possible dangers. Some may argue that this fish will still provide the nutrients that a normal fish provide. Even so, with many potential health hazards, GM food should be labeled so people know what they are getting. A survey from the SF Chronicle states â€Å"95% of the public wants labeling. † (SF Chronicle) If people want a label saying if their food has been genetically modified, then it should be.Even if the same nutrient content is the same, a warning label should be visible before a buyer buys the food so the person has a choice. GM Foods not only can cause severe allergic reactions, but also can contribute the lifelong diseases. An article from The Atlantic states that researchers in China have found new information that shows that we're consuming more than just vitamins an d protein, we are also absorbing information, or microRNA. MicroRNA has been connected to help cause â€Å"cancer, Alzheimer’s, and diabetes. †(Atlantic) This study shows how GM food could influence human health in unanticipated ways.If GM foods do contain microRNA that can severely affect people’s health, then the FDA should warn people of the risk of eating GM food. People who support GM food argue that if we preform test on GM food to look for microRNA, then we must perform the test on normal food. If the FDA decides to test it or not, they still should provide labels stating the risk of microRNA in food. The FDA should require labels on all genetically modified foods so people know what they are eating. By doing so, people will be warned It will warn of the possible risks to their health and have the chance to make better food choices.Health risks that may occur by eating genetically modified foods include severe allergic reactions, cancer, Alzheimer’ s and Dementia, and diabetes. If the FDA does not label these foods, and people don’t know what can happen to them if they consume these foods you can expect to see a rise in lifelong diseases. If people are warned of the potential effects of eating GM foods, they will hopefully make smart decisions regarding their health and the foods they eat. It would be in the best interests of all people to label genetically modified food.

Pondy’s view in the “process of conflict” Essay

Pondy views conflict as a process consists of 5 stages – latent conflict, perceived conflict, felt conflict, manifest conflict and conflict aftermath. Managers can use Pondy’s model to interpret and analyze a conflict situation and take action to resolve it. In latent conflict, there’s no outright conflict but there’s a potential for several sources of conflict, such as interdependence, differences in goals and priorities, bureaucratic factors, incompatible performance criteria and competition for resources. As organization differentiate, activities of different subunits are interdependent. Each subunit develops a desire for autonomy and begins to pursue goals and interests that it values over the goals of other subunits. Since the activities of the subunits are interdepedent, subunits’ desire for autonomy leads to conflict between groups. Differences in subunit orientation affect the way each division views the world and cause each subunit to pursue different goals that are often inconsistent or incompatible. The potential for conflict arises once their goals become incompatible. This is because the goals of one subunit may affect the ability of anothe to achieve its goals. Latent conflict may also arise by the way which task relationships develop in organizations. Conflict can occur because of status inconsistencies between different groups in the organization’s bureaucracy. One of the bureaucratic conflict occurs between staff and line functions. A line function is directly involved in the production of the organizaion’s outputs while staff functions advise and support the line function such as personnel and accounting. In most organizations, people in line functions view themselves as the critical organizational resource and people in staff functions as secondary players. Thus, they always uses its status a the producer of goods and services to justiry putting its interests ahead of the other function’s interests. This results in conflict. Sometimes goals incapability are not the souce of conflict. However, it is because of the way organization monitor, evaluate and rewards different subunits. The way an organization designs its structure to coordinate subunits can affect the potential for conflict as well. Other than thses, conflict may arise because of the limited resouces as well. When resources are limited, choices aobut the allocation of them have to be made and the subunits will have to compete for their share. Divisions will have to fight to increase their share of funding because the more funds they can obtain, the faster they can grow. Perceived conflict is the second stage of Pondy’s model. Perceived conflict begins when subunits perceives that its goals are being thwarted by the actions of another group. Each group searches for the origin of the conflict and constructs a scenario that accounts for the problems that it’s experiencing with other subunits. For example, the manufacturing function suddenly realize that the cause of many of its production problems is defective inputs. After some investigation, they found that the materials management always buys inputs from the lowest-cost sources of supply and makes no attempt to develop the kind of long-term relationships with suppliers that can raise the quality and reliability of inputs. So, the manufacturing will perceive the materials management as thwarting its goal and interests. In felt conflict stage, subunits in conflict quickly develop an emotional response toward each other. Cooperation between subunits and organizational effectiveness will fall if conflict arises. The conflict arises as the different subunits in conflict battle and argue their points of views. The real problem may be relatively minor, but it will turn into a big conflict which become more and more difficult to manage if we didn’t resolve it. It will quickly reach the fourth stage, which is the manifes conflict if the conflict is not resolved. In the manifest conflict stage, one subunits gets back at another subunits by  attempting to thwart its goals. Open aggression between people and groups is common. There are many stories and myths in organizations about board-room fights in which managers come to blows as they seek to promote their interests. Infighthing in the top-management team is very common as managers seek to promote their own careers at the expense of others. Once manifest conflict occur, organizaional effectiveness will suffer because the intefration and coordination between managers and subunits will break down. Managers have to avoid conflict from reaching this stage. If the sources of the conflict was not resoved, it will cause conflict to occur again, but may be in another context. Every stage of conflict leaves a conflict aftermath which affects they way the parties percieve conflict and react to future conflict stages. The aftermath will promote good future working relationships if a conflict is resolved before it gets to the manifest-conflict stage. However, if the conflict wasn’t resolved, the aftermath will be worse future working relationships.

In the United States the military spending is also astronomical. Hunger and food insecurity is not limited to developing nations. In the United States in 2005 approximately 37 million people were living with incomes that were lower than the federal poverty line (Rector & Johnson). The troubles of worldwide hunger and food insecurity have troubled governmental institutions due to the fact that for decades the initiatives associated with development aid, agricultural improvements, and market expansion failed to eradicate hunger. None of these solutions has been effective at battling hunger in the long term. A major issue associated with world hunger is that the prices of food items have been going up. There were major inflationary forces in the prices of food during 2007 and 2008. Food security occurs when all people have physical, social and economic forces sufficient fo od to meet their dietary needs. A factor that can turn a society instantly into a food insecurity condition is a natural event such as an earthquake. In Japan there are over 500,000 people that are homeless and living through condition of food insecurity. It is important for people in the develop world to donate when these types of events occur. The online giant Yahoo Corporation has been able to raise over $6 million in donations for the victim’s of Japan’s 9.0 magnitude earthquake. Three core elements associated with food insecurity are food availability, access to food, and food utilization. There are different reasons or motivators of why one government donates to another. The three key motivators are political, economic, and humanitarian. The United States contributes 60% of the global food aid. The US makes donation at times to improve its political relations with a particular country. The humanitarian efforts are spurred by the media, while the economic variable is a motivator because the country giving food will obtain some sort of economic remuneration for its food products. In addition to the tasks, which they were given as their duties, slaves had very few rights and in fact, they were not allowed to refuse their masters anything, even if it was unwanted sexual advances. In the Roman state, the largest number of slaves was used for agricultural labor because the growing size of both the population and the empire needed plenty of food to sustain them. Therefore, it is true to say there tended to be more slaves in the rural areas than in the urban areas and these worked on the farms. Slaves used to be assigned to mines as punishment for perceived transgressions against their masters, and this was the same as sentencing them to death because the chances of surviving long in the mines were very slim. Farm slaves faired fairly well considering that they had plenty of food to eat where they worked as well as their work being seasonal unlike other slaves who had to work very hard throughout for their masters, while household slaves of the rich families of Rome enjoyed the highest standards of living among the slaves of this state. Black People and Roberta Essay In Toni Morrison’s â€Å"Recitatif,† the story is about two girls, Twyla and Roberta. They grow up in an orphanage because their mothers could not care for them. Morrison makes it clear the girls come from different ethnic backgrounds but never states which one is black or white. At one point in the story Twyla comments, â€Å"We looked like salt and pepper. † I grew frustrated with the story and had to read it several times. I could never determine who was black and white and the lesson I learned should have been it doesn’t really matter. The story begins with Twyla’s mother dropping her off at the orphanage. She meets Roberta and they become best friends. The bond they share occurs because they were not considered real orphans. They were abandoned kids unlike the other children whose parents had died. One of the last times the girls see each other was the day of a visitation. On that night, Twyla’s mother was wearing â€Å"those tight green slacks that made her butt stick out. † Many people have labeled blacks as having larger butts. She could have been black, she could have been a heavy white woman with a large butt, or a Hispanic woman like me. But I automatically stereotyped and went with Twyla has to be black. During the visitation Roberta’s mother â€Å"had brought chicken legs. † Twyla notices Roberta does not eat the chicken legs. I always thought black people liked chicken more than white people which means Roberta was white since she did not eat the chicken. Or maybe she just wasn’t hungry. Shortly after that visitation Roberta’s mother came to take her home, leaving the girls devastated. They see each other several times throughout the years. At their first meeting, Roberta was rude and distant because she was high. Roberta tells Twyla she is on the way to see Jimi Hendrix. Hendrix was an infamous black guitarist. I thought at this point Roberta has to be black. However Hendrix’s band was interracial with a diverse audience. Roberta could have been white due to the diverse audience. I am a huge Hendrix fan and I am not black so why would I think Roberta is. Twelve years later they meet again at a grocery store. Roberta married a rich man and was extremely friendly to Twyla. Twyla cannot hold back her emotions and asks Roberta about the last time they saw each other. Roberta shrugs it off, â€Å"Oh, Twyla, you know how it was in those days: black—white. You know how everything was. † I can relate to this. In 1980, the Cuban Mariel Boat Lifts came over bring thousands of Cubans. I am Cuban but I was born here. Kids I had known since kindergarten treated me as if I just come over on the boats. It had a lasting effect on me and matured me beyond my years. The third time they meet is at the school where their children attend. Roberta and other mothers were picketing because they did not want their kids to be segregated. This led to a fight severing any last chance of a friendship for them as it would not be resolved until Twyla and Roberta meet for a final time. As the story ends I do not get a sense of closure. The question of which girl is white or black remains unanswered. It opened my eyes and made me question how prejudice I really am. I try to not stereotype as a result of what I went through as a child but I found myself doing just that. I can understand why Morrison wrote the way she. When checked for accuracy and reliability of the findings, it was found out that the information would stand the test of time as it was reliable and valid. If another research was to be conducted on the same issue, the same results would be obtained. Sampling error was way below the expected minimum threshold and that if triangulation was also carried out; it could be found out that the data collected was accurate and timely (Beall Sean, 2009). After data has been collected it is analyzed, represented and discussed before arriving at the conclusion on the subject matter. Data can however be analyzed in different ways and represented in different forms like diagrammatic forms like the charts, tables and graphs. This analysis can be done in two different form either qualitative data analysis or the quantitative data analysis. These data need to be analyzed in order to obtain information that is usable and useful to the end users. This information irrespective of whether the data was qualitative or quantitative will describe and summarize the data. This information would later be used to forecast outcomes as well as comparing the variables. Diagrammatic representation is considered the best among the other form of representation s as pie charts would be used to represent the number of people who have migrated to cities. Graphs can also be used to compare the current information and the past that was retrieved from the secondary sources. After the results have been found and analyzed, it should be written in a particular format and stored for future reference. This can be done by having all the data arranged in the themes and categories for future reference. When you have the information present it clearly and logically and should have relevance in your research question. These policies have made city life more attractive and hence have pulled people from other urban areas. Good infrastructure will mean that there will be no congestion in traffic, easy access to industries, reduced number of accidents, and thus individuals take a short time to get to their work places. Nowadays, trains are the dominant mode of transportation throughout the country. Industrialization on the other hand, gained prominence thus creating a national economy. A fast growing industrial nation was fueled by the natural resources from all parts of the country. Legal Firms Most of the Americans move to Washington, DC the capital of the nation, government dominates the city thus there is a huge legal market; large business; and multitude of institutions, museums, cultural activities, and hot spots in the city. Living in DC means that one is an hour away from the mountains, three hours from the ocean, and the beautiful Potomac River and Rock Creek Park for lovers of nature. Majority of United States residents dont like the idea of staying in one state for a long period of time thus move to other cities. Others move because they want fame while others are in search of their loved ones. My feelings concerning the subject is well rooted on the persons reason for moving. As much as I enjoyed this research am well satisfied with the work done for not only did I get to learn a few new things concerning our nation, but also I answered the question. Research will be conducted on a regular basis since time brings about a lot of changes that affect the movement of people and the population at large. The literature in this case is not wrong as it has answered all the questions that arose during my research. My only question that I did not get an answer to was why people are moving to other cities instead of working to achieve what they lack in their own town for it is not a guarantee that they will get all that they need in that new town. Also, they should be aware of the fact that with time that new place will also encounter its own problems. It means that they will have to move again to another town. Data can however be analyzed in different ways and represented in different forms like diagrammatic forms like the charts, tables and graphs. This analysis can be done in two different form either qualitative data analysis or the quantitative data analysis. These data need to be analyzed in order to obtain information that is usable and useful to the end users. This information irrespective of whether the data was qualitative or quantitative will describe and summarize the data. This information would later be used to forecast outcomes as well as comparing the variables. Diagrammatic representation is considered the best among the other form of representation s as pie charts would be used to represent the number of people who have migrated to cities. Graphs can also be used to compare the current information and the past that was retrieved from the secondary sources. After the results have been found and analyzed, it should be written in a particular format and stored for future reference. This can be done by having all the data arranged in the themes and categories for future reference. These policies have made city life more attractive and hence have pulled people from other urban areas. Inadequate compensation of rural producers for the costs incurred to produce food products has aggravated rural poverty. Good infrastructure will mean that there will be no congestion in traffic, easy access to industries, reduced number of accidents, and thus individuals take a short time to get to their work places. Nowadays, trains are the dominant mode of transportation throughout the country. Industrialization on the other hand, gained prominence thus creating a national economy. A fast growing industrial nation was fueled by the natural resources from all parts of the country. Legal Firms Most of the Americans move to Washington, DC the capital of the nation, government dominates the city thus there is a huge legal market; large business; and multitude of institutions, museums, cultural activities, and hot spots in the city. Living in DC means that one is an hour away from the mountains, three hours from the ocean, and the beautiful Potomac River and Rock Creek Park for lovers of nature. A cross-section of society: lawyers, government employees, the homeless, business people, college students, and famous Hollywood actors are found occasionally on the streets. DC has a large population due to its vast availability of resources that enable people to improve their living standards. Job opportunities are also high as compared to other states (David, 2009). Delaware is the second smallest state, but has elegant beaches such as Bethany, Rehoboth, and Dewey are tourist attraction sites. Rehoboth beach has been transformed to a refined, cosmopolitan town which has enabled people to migrate to it as it has valleys like Brandywine which have blooming gardens, tranquil creeks, and mansions like Nemours, Kennett Square, home of the magnificent Longwood Gardens, and decorative arts and landscape. Majority of United States residents dont like the idea of staying in one state for a long period of time thus move to other cities. Others move because they want fame while others are in search of their loved ones. My feelings concerning the subject is well rooted on the persons reason for moving. As much as I enjoyed this research am well satisfied with the work done for not only did I get to learn a few new things concerning our nation, but also I answered the question. Research will be conducted on a regular basis since time brings about a lot of changes that affect the movement of people and the population at large. The literature in this case is not wrong as it has answered all the questions that arose during my research. My only question that I did not get an answer to was why people are moving to other cities instead of working to achieve what they lack in their own town for it is not a guarantee that they will get all that they need in that new town. Also, they should be aware of the fact that with time that new place will also encounter its own problems. It means that they will have to move again to another town.

The Second Sex by Simone de Beauvoir In the chapter of her book The Second Sex entitled â€Å"the Woman in Love,† Simone de Beauvoir characterizes the romantic ideal of the relationship with a man as a woman’s purpose as a form of self-deception (translated here as â€Å"bad faith†). The self-deception de Beauvoir describes is based in the thesis of The Second Sex. This is the idea that women have been deceived into believing that they are second-class humans. Western culture, according to de Beauvoir, teaches us that women are missing some elusive element of the self that endows men with freedom- a concept essential to the existentialist definition of the conscious being. Therefore, a woman can never find fulfillment as a thinking person as long as she believes that men are free beings and women their dependents. This state of affairs is reinforced through an all-encompassing system of thought that posits man as subject and woman as object, â€Å"doomed to dependency.† (In this chapter, de Beauvoir writes about the â€Å"modern woman† whose consciousness of her self has not yet matured. Therefore, when â€Å"woman† is referred to here, this is merely shorthand for the self-deceiving woman. The independent woman is another matter entirely.) De Beauvoir postulates that the reason why women’s idea of love is so much more intense than men’s is because the woman, unable to become a whole person in and of herself, thinks that by attaching herself to a man she can transcend her position in life. She can move from object to subject through osmosis- the ultimate expression of â€Å"being for the other.† She can claim a share of his activities and his accomplishments in the public realm which she is prohibited to enter. Giving herself wholly to the man ... ...that many women cling to even after they give up hope that â€Å"he† will ever come. Is there a solution to this paradox, this Catch-22 that de Beauvoir describes? Yes, she says, but only when certain conditions are met. First, a woman must have a solid sense of herself as an existentialist â€Å"free being† before she goes looking for love. Second, the love relationship must be a freely chosen association of equals committed to respecting each other’s freedom. As de Beauvoir writes on p.667: â€Å"Genuine love ought to be founded on the mutual recognition of two liberties; the lovers would then experience themselves both as self and as other; neither would give up transcendence, neither would be mutilated; together they would manifest values and aims in the world. For the one and the other, love would be revelation of self by the gift of self and enrichment of the world.†

Throughout the film, the main overall theme is that a woman had an illegitimate daughter with someone while she was married, her husband left her, and she was alone with three girls and the youngest, Tita, was to never marry because she was to take care of her mother until the day she died. As Tita grew her and a boy, Pedro, fell in love, but her mother would not allow her to marry, and instead, he married her sister, Rosura, to be close to her. Pedro and Rosura had their last child and Rosura vowed she would not be able to marry because she too, like Tita, would have to take care of her until the day she died. Tita very much hated this idea, as she hated how her mother controlled her and forbade her to not marry her only love, as seen at the end when Rosura dies, Pedro and Tita are now able to get married at last. This silly tradition of the youngest girl taking care of her mother shows the power of family traditions and most likely, a Latin American tradition. The mother was ...

Facts of the Case Essay

The video of case number 82A04-8876-CV-285, White vs. Gibbs and O’Malley’s Tavern, is a video where the defendant is going before judges seeking summary judgment as a matter of law in their favor. Debbie White has sued Patrick Gibbs under the civil provisions of Indiana’s Dram Shop Act, Indiana Code 7.1-5-10-15.5. This case was brought in diversity before the United States District Court for the Northern District of Indiana due to the parties residing in two different states. The case will be decided under Indiana state law. The purpose of this trial is to argue the motion of summary judgment. A summary judgment is â€Å"a procedure used during civil litigation to quickly resolve a case without a trial. The judge grants summary judgment only if there are no disputes as to the material facts of the case and the party is entitled to judgment as a matter of law†. The plaintiff in this case is Mrs. White and attorneys Amanda Babot and Jackson Walsh represent her. The defendant in this case is Mr. Gibbs and O’Malley’s Tavern being represented by Attorneys Benjamin Walton and Jordan Van Meter. Mr. Walton is addressing the issue of actual knowledge of visual intoxication as required under the Indiana Dram Shop Act. Mr. Walton argued that Mr. Hard was not engaging in any activities that would have adequately demonstrated intoxication. Hard was simply sitting at a bar in the presence of John Daniels, the bartender. The only evidence of Mr. Hart being intoxicated is that he was more â€Å"chatty† than usual. According to the Indiana Supreme Court, â€Å"if increased talkativeness is the only evidence, that is insufficient as a matter of law to support any reasonable inference of actual knowledge.† (Delta ta Delta). Mr. Van Meter is addressing the issue of approximate causation for the defense. Mr. Hard’s criminal act is a super ceding intervening cause, which breaks the cause of connection between the negligence of the defendant and the injury. Also, because this was a criminal act, the injury that resulted was not a natural and probable consequence that w as reasonably foreseeable in light of the circumstances. Mr. Walsh, the plaintiff’s attorney, is presenting the issue of actual knowledge of intoxication. Mr. Walsh is arguing against summary judgment based on two reasons. First, Indiana Courts have held that when a reasonable inference of evidence and circumstances of a case could result in more than one conclusion, summary judgment is inappropriate. Second, the jury could infer that the bartender had actual knowledge of the visible intoxication of Mr. Hard when he last served him alcohol. Ms. Babot is arguing against summary judgment based on approximate cause due to three reasons. First, there are reasonable inferences that a jury could make in favor of the plaintiff. Second, the injuries to Mrs. White were the reasonable and foreseeable consequences of serving an intoxicated patron. Thirdly, a criminal can be the intervening act that does not break the chain of causation because the act is reasonably foreseeable. Ms. Babot listed four factors that a judge has to look at when considering approximate. What and how much alcohol was consumed, what is the amount of time it was served in, the conditions of the patron before leaving the bar, and the condition of the patron immediately after leaving. Facts There were previous incidents where Mr. Hard and Mr. White had altercations. On one incident, Hard and Mr. White were in a physical altercation and had to be separated. During this incident, Mr. Hard was sober. This shows that there is a history of Mr. Hart trying to physically hurt Mr. White. In this particular case, Mr. and Mrs. White went to O’Malley’s Tavern. Edward Hard, Mrs. White’s former lover, was also at the tavern that night. Mr. Hard’s bar tab shows that he purchased 13 alcohol drinks, in a 2 hour and 40 minute period. Before Mrs. White arrived at the Tavern, he had five drinks. In roughly a half hour, John Daniels, the bartender, served Edward Hart five shots of whisky and one beer. Mr. Daniels was the only bartender working the night of July 28th so he served all the shots of liquor and other alcoholic beverages to Mr. Hard. When Mr. Hard finished his last shot of liquor, Hard tried to stand up from his barstool and tripped over a pool stick and fell. The bartender was not in the room when Hart fell. By the time John Daniels came back into the room, Edward Hard was already up and back on his bar stool. The bartender then served him another beer. When Mr. Hard saw Mr. and Mrs. White leaving, he finished his drink and proceeded to pursue them. At 7:43 pm, he was served his last drink. Five minutes later he paid and leaves. Once outside, Mr. Hard raised his hand in an attempt to strike one of them, but as he swung, he fell to the ground. Once the Whites were in their car and leaving. Mr. Hard started his car and sped out of the parking lot recklessly hitting cars and other items on his way out. Mr. Hard was also swerving erratically while driving after Mr. and Mrs. White. The 911 call showed that Mr. Hard was on the wrong side of the road when Mrs. White made a left hand turn. Mrs. White also said that Mr. Hard was following them. Before the collision, Mr. Hard did not slow down as he drove straight into Mrs. White car. At 7:55 p.m., the police report is taken for the accident. Mr. Hard was disheveled, swaying, staggering, unable to speak coherently, and having poor hand-eye coordination. Issue The legal issue is whether the O’Malley’s Tavern is legally responsible for the Mrs. White’s injuries and Mr. White’s death. If the bartender had actual visual knowledge of Mr. Hard’s intoxication, then the tavern can be held responsible for the incident. [What is the legal issue that this case hinges on? If the bartender was not in the room to witness Mr. Hard fall down while he was still drinking, then there was no action to show the level of Mr. Hard’s intoxication. It would be difficult to gauge how intoxicated Mr. Hard was based on him drinking. The first time that the bartender would have truly noticed that he was intoxicated was after Mr. Hard had finished drinking and fell down when he tried to hit Mr. White as he was leaving. Since there was a history of altercations between Mr. Hard and Mr. White, as well as the same night of the accident, it is safe to reason that Mr. Hard running into the White’s vehicle was meant to cause harm to Mr. White. This would make the action premeditated and thus a criminal offense, not negligence on the tavern behalf.

The consequence and effect of this war was mainly dependent on destiny of the Philippines and the outlook itinerary of the war in opposition to Japan.Leyte, situated in the middle of the archipelago, was the central point, so the forces of Southwest Pacific controlled by General MacArthur and the forces of Central Pacific lead by Admiral Nimitz converge here to extort the Philippines from the seize of the rivals. General MacArthur had advantage of Leyte due to its reachable distance to other islands for the strike either by ground or air forces. Leyte was place were Japan would be forced to surrender in central Philippines providing launch pad for final attack against Japan.General MacArthur and Admiral Nimitz were dedicated to make use of the utmost resources at their authority (Reports of General MacArthur, 197-200). It was obvious that Japan would put its best effort with all its strength up to the eleventh hours to set aside the Philippines. But Japan was continuously facing difficulties to keep hold in the battle and before reaching the end of the year 1944, the situation of this nation was very much dangerous and frantic. Almost all the allies had contracted their hand from external fringe of her defense system.According to Reports of General MacArthur (197-200), â€Å"They were now poised with their full power at the very threshold of her inner structure and if they should break through, the Homeland itself would stand dangerously exposed-an inviting target for the next invasion†. Due to behavior of the allies and the inferior qualities of the forces of Japan in comparison to America, the war had reached to a decisive stage and only one defeat of Japan would lose all the glory of empire of the century.The inhabitant of Philippines had only one chance to offer to Japan for saving from the forces of General MacArthur. Undoubtedly the Japanese forces came with all its strength and efforts to face the invasion of America. Japanese were aware with the fact that if the Philippines were defeated then there were no any chances to be in the war and the war was also lost consequently. Henceforth, they prepare a destructive plan risking their left behind surface forces offering Philippines a distant possibility of demolishing the American assault fleet and separating the Allied forces on ground on Leyte.This plan was mainly reliant on the use of decoy force, which was already, tried early as operational plan by Japan. Now Japanese carriers were prepared fully except it had no trained-aircrew, so the ships were chosen for playing the most important role of decoy. Vice Admiral Ozawa arranged four aircraft carriers together with other twelve ships from the North and siphon off the major American force. At the same time two more commanding battleship forces would infiltrate the Central Philippines and then congregate on the assault ship in Leyte Gulf.In the consequence of the combat against the Americans for the Philippines, the Japanese had to invest a great deal in terms of battle force, finance and dignity in Leyte only to lose. In this campaign they had to sacrifice four divisions and many distinct combat units. The naval force had also to lose major warships nearly twenty-six full-fledged units along with forty-six great transportation and merchantmen. The land-based air capabilities were also diminished by nearly fifty percent and Japanese had to rely on only kamikaze pilots who act was totally suicidal. But America had to face mixed result due to this campaign.As the duration for this battle was not expected to be such long, so the island become difficult for the base of the army. Other set back like quite a lot of intelligence failures including the failure of MacArthur's headquarters failure to discriminate Japanese purpose to fight a crucial battle on Leyte, made the battle unexpectedly long. This causes less air force and naval force to cover the battle troop and they could not prevent additional enemy troops to arrive at the position . This was a major drawback in planning and strategy of the battle by the American side.The valor shown by a Japanese soldier with full dedication in defensive war methods to use the difficult terrain for his own advantages and his commanders willing to sacrifice their life, cause difficulty in fighting any decisive war. When Admiral Halsey took the bait on 24th October in the afternoon, one of his search planes marked the Japanese Northern Force decoy convoy which were carrying four carriers faraway to the north of Leyte. Taking the attention toward this happening, Admiral Halsey commanded his whole third fleet into chase, he left Leyte Gulf in total exposure as Japanese had expected.By the next morning a heavy battle was fought at Cape Engano where Japanese Northern Force were lost to Halsey carrier planes of third engagement which also included battleships' guns. To fight the main combat, Halsey had to return at Cape Engano leaving that battle. In The Battle of the Surigao Strait , the Japanese Center Force along with Southern Force, had survived the air combat in the night of 24th and 25th of October and motivated on their divided paths in the direction of Leyte Gulf and MacArthur's conveys and escort carriers. In The Battle of Samar Island, Kurita's Center Force, including the super battleships viz.Yamato and Musashi, fruitfully stirred through the constricted San Bernardino Strait, after that south down the east coast of Samar Island, situated northeast of Leyte, in the range of the Seventh Fleet's softly targeted by dawn on 25th October 1944. In the Battle off Samar, the Japanese were conflicting by slighter, frivolously armored ships, which in principle had no counterpart for heavyweights of Kurita. The commander of Japanese Center Force, Kurita by mistake understood that he was betrothed with America’s Third Fleet carriers.Sprague took benefit of smoke screens and a rainsquall to decrease the visibility of Japanese and accuracy of fire. All the engagement together were known as the Battle of Leyte constituting the biggest naval battle at the time of World War II in the Pacific. This may be regarded as the largest in any history till date. The Japanese had to lose more than twenty-six vessels of warships.
